The article “Selection Inventions Different interpretation of the case law of the Technical Boards of Appeal of the EPO” by Andrea Lautner-Rieske was published in IP kompakt.

The author discusses a series of decisions of the Technical Boards of Appeal of the EPO, dealing with the assessment of novelty of selection inventions. In particular, the relevance of the third criterion, as established in T 0198/84 referring to the requirement of a new technical teaching of the selected subject-matter, is assessed differently in the different decisions when assessing novelty.
