Update on UPC

On February 28, 2020, the UK government indicated that the UK will not join the UPC as a consequence of the Brexit. However, the UK has not yet officially left the UPC.

On March 20, 2020, the German Federal Constitutional Court has announced its long awaited decision and has ruled that the German ratification law for the Agreement on a Unified Patent Court (UPC Agreement) is void due to formal errors in the ratification process.

These two recent developments, together with the ongoing coronavirus crisis, will at least delay the implementation of the UPC for a long time.
